We have obtained rulings dismissing claims with prejudice, granting judgment on the pleadings, upholding the application of attorney client privilege and work product related to the engagement of forensic investigation firms, and defeated motions for class certification. BakerHostetler is a leader in the defense of Multidistrict Litigation across practice areas. In privacy and data breach litigation, our lawyers lead the defense of the most significant MDLs including In re AT&amp;T, In re Marriott, In re MOVEit, and In re Fortra. Our experience includes the organization and efficient management of MDLs which are designed to address in a single court overlapping and copycat cases originally filed in multiple courts.

Data Breach Class Action Litigation

Our Privacy and Digital Risk Class Action and Litigation team has defended more than 300 post-data breach related lawsuits. Our industry experience includes education, energy, financial services, healthcare, hospitality, retail, technology, transportation and other major sectors, and we are internationally recognized for the strength of our litigators and courtroom strategies.

We are nationally recognized for our healthcare privacy litigation experience and have served as defense counsel in several of the largest data breaches in the healthcare industry. Our class action defense team has successfully represented major insurance businesses and health systems across the country, minimizing monetary and reputational damage and negotiating with state and federal regulators.

When payment card incidents are detected, we provide clients with immediate response guidance and plans designed to help companies comply with applicable laws while remaining focused on protecting the company’s reputation and financial resources. We have guided more than 250 companies through attacks on their payment processing systems. We lead clients through the critical moments of the response, from first discovery through containment, privileged and PFI investigations, consumer and regulatory notifications, and remediation, mindful of opportunities to mitigate liability at each step.

BakerHostetler has significant experience defending clients in privacy class actions involving claims that customer data collection practices or the use of adware, social media, and analytics technologies on websites violate state and federal consumer privacy laws.

Pixel Healthcare Litigation

BakerHostetler is currently defending a number of hospital systems in putative class actions pending in every region of the United States concerning the hospital systems’ alleged use of the Facebook Pixel and other third-party analytical tools on their public facing websites and patient portals. Our Healthcare and Litigation teams are working with clients by defending in class action litigation, helping with HIPAA regulatory and privacy obligations with Facebook and other applications, assisting with digital privacy policies and compliance, and responding to state attorneys general and the Office for Civil Rights.

BakerHostetler is currently defending more than 75 of these suits nationwide, including dozens in the state of California.

These cases involve putative class actions or arbitration demands for violations of various states’ wiretapping and privacy statutes concerning claims that alleged online “communications” with visitors to the companies’ websites were tracked, recorded, and stored via “spyware” without consent and/or for practices associated with online chat technology.

We are representing or have represented well over 50 retailers, insurers and healthcare providers in pixel tracking, cookie and session replay cases. Companies include Sephora, Petco Animal Supplies Stories Inc., The Cheesecake Factory, Inc., Talkspace, True Value, Liberty Mutual Insurance Company, Orlando Health, Warby Parker, The Orvis Company, Inc., Black Rifle Coffee Company, Bath &amp; Body Works, Inc., and Genesco Inc.

Video Privacy Protection Act

We have defended putative class actions under the Video Privacy Protection Act (VPPA) since their inception and throughout their evolution as plaintiffs’ attorneys have attempted to apply this outdated and cumbersome statute to evolving technologies. From defending a nationwide video rental chain (i.e., the industry to whom the VPPA was meant to apply) to social media video apps to digital news services, we have been involved each step of the way.

BakerHostetler was the leader in defeating CMIA claims (both on dismissal and at summary judgment) in very early days, effectively trimming the impact of that statute on the California market. (Eisenhower Medical Center. v. Superior Court (Malanche), Case No. INC1108128 (Fourth Circuit); (Doe v. Sutherland Healthcare Solutions, Case No. BC539436 (Superior Court, California, County of Los Angeles).

BakerHostetler also represented Sephora in the first-ever CCPA settlement with the California Department of Justice, announced on August 24, 2022. The settlement was the result of a year-long investigation by the Office of the Attorney General and included a $1.2M monetary penalty and a 2-year audit and reporting as an injunction.
