The Differing Regulatory Definitions of PFAS-Containing Products

Lindsey has extensive experience engaging with the U.S. Environmental Protection Agency, the California Air Resources Board (CARB)&nbsp;and other regulators on Title II of the Clean Air Act. She has advised automotive and other mobile equipment manufacturers&nbsp;and related industries&nbsp;on emissions standards, vehicle and fleet certification, defeat device allegations, onboard diagnostics (OBD) compliance, field fixes, recalls, import and export compliance, engine and vehicle labeling and zero-emission&nbsp;vehicles.

Lindsey has also counseled&nbsp;clients on permits under Section 404 of the&nbsp;Clean Water Act, cost-sharing under the Comprehensive Environmental Response, Compensation&nbsp;and Liability Act (CERCLA), marine fisheries compliance under the Magnuson-Stevens Fishery Conservation and Management Act, drafting environmental impact statements as required by the National Environmental Policy Act (NEPA), complying with the Toxics Release Inventory (TRI) under the Emergency Planning and Community Right-to-Know Act (EPCRA) and has assisted clients in meeting state and federal regulations concerning PFAS chemicals and their presence in consumer goods.

Lindsey also has significant internal investigations and litigation experience and has worked with clients in the automotive, banking, financial services&nbsp;and consumer products industries and represented them in all phases of complex commercial litigation.

Lindsey is committed to public service and pro bono work. In 2018, she successfully represented a wrongfully convicted client who was released from prison after nearly 25 years. She has also worked to expunge criminal records and to defend victims of child abuse. As an Army wife, Lindsey has worked with many veterans and military family legal groups and focuses on upgrading military discharge statuses.
