Investor State Disputes

<li>Represented investors in ICSID treaty dispute, True Blue Development and others v. Grenada, relating to Grenada’s withdrawal of funding for development of hotel resort.</li>
<li>Representing a Luxembourg investor in an ICSID arbitration seeking compensation from Slovenia for multiple breaches of the Energy Charter Treaty.</li>
<li>Represented North American forest products company in sovereign investment dispute under NAFTA against Government of Canada related to Nova Scotian measures designed to aid local paper producer. As part of representation, obtained decision that defeated jurisdictional dismissal sought by Canada.</li>
<li>Represented U.S. mining company in sovereign investment dispute under NAFTA against relating to dissipation of energy assets caused by Albertan payout to local energy companies.</li>
<li>Represented International Scholars as amicus curiae in briefing before U.S. Court of Appeal for the D.C. Circuit concerning enforcement of ICISD awards in the United States in NextEra and 9Ren v. Spain.</li>

Commercial Arbitration Disputes

<li>Representing international water products manufacturer in ICC arbitration against prime contractor for contractual breach of arbitration claims.</li>
<li>Representing financial services product provider in ICDR arbitration for breach of contract dispute relating to failure to honor indemnity.</li>
<li>Represented financial services product provider in successful defense of breach of contract claims in AAA arbitration, leading to summary disposition of dispute prior to discovery.</li>
<li>Represented government contractor in arbitration accused of fraud and making false statements resulting in its termination from a $50 million contract. Following 10-day hearing, a panel of three arbitrators awarded the client lost profits caused by the breach of contract.</li>
<li>Represented Asian contractor in ICDR arbitration for breach of contract claims relating to failure to procure goods.</li>
<li>Represented international energy services provider in ICDR arbitration for breach of contract dispute arising out of failure to pay contractually owed amounts.</li>

Litigation 
<ul>
<li>Representing Native American manufacturer in business-divorce dispute against former high-ranking employees accused of breaches of fiduciary duty and other misappropriation of company assets.</li>
<li>Represents prolific inventor in complex patent litigation brought by a U.S. federal agency seeking to invalidate all pending patent applications. After trial ended in favor of client, participated in additional trials for client that led to judgments requiring federal agency to award client patents.</li>
<li>Representing financial services provider in breach of contract dispute arising out of alleged theft of intellectual property.</li>
<li>Representing automobile manufacturer in challenge to rules limiting direct sales of automobiles to consumer by manufacturers.</li>
<li>Representing software maker in defense of lawsuit brought for alleged defamation and other business wrongdoings.</li>
<li>Part of legal team representing British barristers accused of breach of fiduciary duty by a member of a royal family and numerous corporate entities. Jury verdict was obtained and damages were awarded. Involved in all critical aspects of the case, including witness preparation, depositions, motions practice, trial work and post-trial briefing.</li>

Enforcement, Asset Tracing and International Discovery 
<ul>
<li>Represented international petroleum services company in enforcement of international arbitration award under ICC rules. Award confirmed in full by U.S. federal court, leading to enforcement proceedings against foreign parties and payment of award.</li>
<li>Represented U.K.-based energy company in obtaining recognition of British judgment in the U.S.</li>
<li>Representing Bermudian receivership in seeking recovery of assets from international investment fraud.</li>
<li>Representing investor in seeking multijurisdictional discovery under 28 U.S.C. § 1782 for aid in Bahamian litigation.</li>
<li>Coordinated with Canadian and Antiguan co-counsel in cross-border asset recovery action for Antiguan corporate entity, a corporate victim of illegal expropriation by a sovereign government. As part of strategy, helped obtain information pursuant to 28 U.S.C. § 1782 (including defeating a challenge to the discovery) to locate and recover foreign assets in satisfaction of foreign judgment.</li>
<li>Represented foreign client in obtaining discovery under 28 U.S.C. § 1782 to locate bank records and other documents for use in foreign litigation to acquire control of British Virgin Islands company.</li>
<li>Represented importer in defense of a foreign judgment enforcement. After assisting with resolution of foreign judgment disputes, assisted the client to structure future agreements to ensure fair forum for potential future disputes.</li>
<li>Represented a foreign private equity fund in ICC arbitration for international contractual dispute that proceeded to arbitration and assisted with subsequent vacatur of award obtained by client.</li>
