Total loss valuation cases and labor depreciation cases dominated the past quarter. Courts continued the trend of rejecting challenges to condition adjustments in total loss valuation cases but allowing challenges to the projected sale adjustment to proceed. In labor depreciation class actions, the trend in favor of insureds continued, with a Texas putative class allowed to proceed to the merits. Both sets of claims also saw new theories cropping up.
